Photography Session Terms and Conditions

ALL WAYS FOTO PHOTOGRAPHY SESSION TERMS AND CONDITIONS

This document sets out the terms governing bookings and the delivery of photography sessions and event coverage provided by All Ways Foto.

  1. BOOKING A SESSION

Bookings are made through the booking system available at www.allwaysfoto.com or through a personalised link provided by the photographer.

Submitting a date request does not automatically confirm the session. The booking becomes binding once the date has been confirmed by the photographer, these terms have been accepted and the €40 booking fee has been paid.

The photographer may suggest a different date if the selected date, studio or location is unavailable.

The booking fee must be paid within 3 days of the date being confirmed. If payment is not received within this period, the request may be cancelled.

Once the booking has been confirmed, the photographer and the client will agree on the details, purpose and location of the session. The final location will be chosen based on the type of photographs, the availability of the studio or space, weather conditions and the participants’ needs.

Before the session, the client will receive a short guide with advice on preparation, clothing and styling.

By completing the booking, the client confirms that they have read and accepted these terms.

2. PACKAGES AND PRICING

Pack Esencial – €129

• 7 edited digital photographs;
• 1 look; a second may be included if time allows;
• approximately 45 minutes of shooting time;
• a gallery containing approximately 30–60 fully edited, carefully selected photographs.

Pack Completo – €179

• 15 edited digital photographs;
• up to 3 looks, meaning a maximum of 2 outfit changes;
• up to 60 minutes of shooting time;
• a gallery containing approximately 45–80 fully edited, carefully selected photographs.

The prices above apply equally to standard sessions held in a studio, outdoors, at the client’s home or at another agreed location. All prices include VAT.

The applicable price is the one displayed on the website or in the booking system when the booking is made.

The photographer may prepare a personalised proposal for a specific project. In that case, the price, scope and terms stated in the proposal will apply.

Non-standard sessions, complex productions, the hire of a specific venue, professional styling, special sets or props may require a bespoke quotation.

 

3. PAYMENT

The €40 booking fee forms part of the price of the selected package and is non-refundable if the client cancels the session.

The remaining balance must be paid no later than the day of the session, unless otherwise agreed.

Payment may be made by BIZUM, bank transfer or cash. Cash payments are made during the session.

Preparation and full editing of the gallery will begin once payment for the package has been received.

Additional photographs, the full gallery and any other products will be made available for download or ordered once the relevant payment has been received.

For sessions outside Madrid, previously agreed travel, accommodation or other production expenses may be added.

 

4. RESCHEDULING AND CANCELLATIONS

The client may request to reschedule no later than 72 hours, meaning 3 full days, before the scheduled session.

If the request is made within this period, the booking fee will be transferred to the new date. The session may only be rescheduled once under these conditions.

If the request is made less than 72 hours before the session, the booking fee will be forfeited. A new booking fee is required to reserve another date.

If the client cancels the session entirely, the booking fee is non-refundable.

Exceptional health-related circumstances or events beyond the client’s control may be considered individually, but this does not automatically exempt the client from these terms.

Failure to attend without prior notice will result in an obligation to pay 75% of the price of the booked package.

If the session cannot take place for reasons attributable to the photographer, the client may choose a new date or receive a refund of the booking fee.

 

5. WEATHER CONDITIONS FOR OUTDOOR SESSIONS

The photographer will monitor the weather forecast before a scheduled outdoor session.

The photographer will decide whether the session can proceed, taking into account the safety of the participants and equipment, the available light and whether the intended result can be achieved.

If the weather conditions make it impossible to work safely or as planned, the session will be moved to a mutually agreed date.

In this case, the client will not lose the booking fee. The full amount will be transferred to the new date.

A weather-related postponement initiated by the photographer will not count as the client’s one permitted rescheduling.

 

6. LOCATIONS AND STUDIO SESSIONS

The session may take place in a studio, outdoors, at the client’s home, at another mutually agreed location or in a space where the photographer sets up a mobile studio.

The location will be agreed after the booking has been confirmed and will be selected to suit the purpose, style and participants of the session.

Studio sessions require prior confirmation of the selected studio’s availability.

The photographer may recommend a studio suitable for the type of photographs, the number of participants, the planned looks and a location convenient for the client.

If the client chooses a non-standard studio or venue that generates additional costs, a surcharge may apply. The client will be informed before the location is finally confirmed.

The client and all other participants must comply with the rules and safety requirements of the selected studio or rented venue.

 

7. EXTENDING THE SESSION

Any extension must be agreed and booked in advance.

Prices for one additional hour:

• €80 outdoors;
• €110 in a studio.

An extension provides more time for photographs and additional outfit changes. Outdoors, the extra time may be used to work with a wider variety of settings or change location. In a studio, it may be used for additional available sets, backgrounds or arrangements.

Extending the session does not increase the number of photographs included in the selected package. The number of photographs remains the one included in Pack Esencial or Pack Completo.

The possibility of extending a studio session also depends on the studio’s availability.

 

8. DURING THE SESSION

Before the session, the photographer and the client will agree on its general purpose, style, character and location.

The photographer will guide the participants with posing, positioning and movement while leaving room for freedom, natural interaction and spontaneous moments.

The session will be adapted to the participants’ abilities and, in particular, to the age, well-being and needs of children.

If the client arrives late, the session will not automatically be extended. It will end at the time stated in the booking, especially when it takes place in a hired studio.

The photographer is not responsible for a reduced variety of photographs or for planned looks that cannot be completed because of the client’s late arrival.

For children’s sessions, a parent or legal guardian must be present and supervise the child throughout the session.

If an animal takes part, its handler must keep it fully under control and will be responsible for any damage it causes.

 

9. ATMOSPHERE AND SAFETY

The photographer’s priority is the safety and well-being of all participants, especially children.

The session will take place in an atmosphere of respect and cooperation and will be adapted to the abilities of the people being photographed.

Physical or verbal abuse, including abuse directed at children, is not permitted and must not be used as a way of encouraging anyone to pose.

The photographer may stop the session in the event of aggressive, offensive or unsafe behaviour.

If the session is stopped because of the behaviour of the client or another participant, the full price of the booked package remains payable.

The photographer may refuse to take a particular photograph if she believes that doing so would pose a risk to the participants, animals, equipment or surroundings.

 

10. GALLERY AND PHOTO SELECTION

Within a maximum of 7 working days after the session, the client will receive a link to a private online gallery, provided that the package has been paid for.

The gallery will contain the best images selected by the photographer, fully edited in her signature style:

• 30–60 photographs for Pack Esencial;
• 45–80 photographs for Pack Completo.

These figures are approximate. The final number will depend on the type and course of the session.

The photographer is solely responsible for the professional selection of the material. The client will not receive every image taken, rejected duplicates, unsuccessful frames or RAW files.

The client will select the number of photographs included in the purchased package from the gallery.

As all photographs in the gallery are already fully edited, the selected files will be made available for download once the selection has been confirmed and all outstanding amounts have been paid.

The final photographs will be delivered as high-resolution digital files suitable for printing and online publication.

The gallery is private. The client decides who may receive the link and access the photographs.

 

11. ADDITIONAL PHOTOGRAPHS AND THE FULL GALLERY

The client may purchase additional photographs for €10 each.

The full gallery may be purchased for €130. This option is available with both Pack Esencial and Pack Completo.

The client may decide whether to purchase additional photographs or the full gallery after viewing the completed gallery.

The full gallery includes all final photographs selected and edited by the photographer and placed in the client’s private gallery.

Additional photographs or the full gallery will be made available for download once the relevant payment has been received.

 

12. SCOPE OF EDITING

Editing is carried out in the photographer’s signature style, as shown in her portfolio.

Standard editing may include:

• adjustments to colour, light and contrast;
• cropping and straightening;
• removal of minor background imperfections;
• evening out or extending studio backgrounds;
• removal of small, accidental elements;
• minor clothing adjustments, such as removing a visible label;
• removal of temporary skin imperfections, such as spots, minor rashes or bruises.

Standard editing does not include significant changes to a person’s appearance, including slimming the body, altering the shape of the face, nose or lips, changing body proportions, replacing clothing or creating complex composites.

Advanced retouching, composites or additional alterations may be quoted separately.

After receiving the photographs, the client may request one round of minor technical adjustments. This does not include changing the accepted editing style or creating a completely new version of an image.

 

13. GROUP BOOKINGS

A group booking applies when at least two people book their own individual sessions to take place consecutively at the same location, within the same reserved time slot and without the need to reset the equipment or move to another location.

Each person selects and pays for their own package and receives an individual gallery.

The first person pays the full price of the selected package. The second and each subsequent person receives a €25 discount on their package.

The discount only applies if all sessions take place under the group-booking conditions.

If one person cancels, the remaining participants may lose their discount if the group-booking conditions are no longer met.

The group-booking discount cannot be combined with other discounts, promotional codes or the All Ways Club discount unless the photographer expressly states otherwise.

 

14. REFERRAL PROGRAMME

A new client making their first booking following a recommendation from an existing client receives a €10 discount on their first session.

The referring client receives 2 additional edited digital photographs during their next standard session.

The new client must provide the referring client’s full name when booking.

The referral reward will be granted once the new client has completed and paid for their first session.

The additional photographs cannot be exchanged for cash, used as a discount on the package price or divided between several sessions. They must be used during one subsequent session.

The referral programme cannot be combined with other discounts or promotions unless the photographer expressly states otherwise.

 

15 ALL WAYS CLUB

All Ways Club is an annual membership programme for All Ways Foto clients.

The membership fee for the first edition is €69 for 12 months and is paid as a single payment.

The number of places may be limited. Registration will open during specified periods, provisionally twice a year.

Membership includes:

• participation in one Agency Test Day during the membership year;
• early access to selected editorials, themed sessions and Photo Days;
• a €10 discount on standard photography packages.

Agency Test Day is a group photography day held at a date and location selected by the photographer. Its purpose is to create updated photographs for a portfolio, model book or agency applications.

An unused Agency Test Day place cannot be exchanged for cash or carried over to the next membership year.

Membership and its benefits are assigned to the registered member and cannot be transferred. Membership does not guarantee the availability of any particular session date.

The club discount cannot be combined with other codes, discounts or promotions unless the photographer expressly states otherwise.

 

16. EVENT PHOTOGRAPHY

Event photography includes baptisms, birthdays, family gatherings, performances and other celebrations.

The price depends on the photographer’s working time:

• 1 hour – €121 per hour;
• 2 hours – €114.95 per hour;
• 3 hours – €108.90 per hour;
• 4 hours – €102.85 per hour;
• 5 hours or more – €96.80 per hour.

The minimum booking is 1 hour. After the first hour, additional commenced 30-minute periods may be charged if provided for in the agreed proposal.

The number of delivered photographs is not strictly limited. The client will receive a professionally selected and edited set of images documenting the event.

The price includes professional selection, full editing and a private online gallery. The final number of photographs depends on the duration and nature of the event, the number of participants and how the event unfolds.

Weddings and First Communions have separate packages and may be subject to different terms.

The delivery time for event photography will be specified in the individual proposal prepared for the event.

 

17. COPYRIGHT AND USE OF PHOTOGRAPHS

The photographer retains all moral rights and copyright in the photographs she creates.

The client receives the right to use the purchased photographs privately, including making prints, sharing them with family and friends and posting them on personal social media profiles.

Commercial use or providing the photographs to a business, brand, agency, magazine or other publication requires prior agreement regarding the scope of the licence.

The photographer will never publish photographs showing recognisable individuals without obtaining the appropriate consent.

Photographs showing recognisable individuals may only be used by the photographer in her portfolio, on her website, on social media or in promotional materials with the consent of the client or the person photographed.

Photographs in which a person is not visible or identifiable, such as details, hands, figures photographed from behind or wide shots, may be used in the photographer’s portfolio without additional consent, provided that they genuinely do not allow the participants to be identified.

The client should not change the colours, apply filters or make other alterations that affect the photographer’s artistic style.

Automatic cropping applied by a social media platform is permitted. Whenever possible, photographs should be published in their original proportions.

 

18. LIABILITY

The client and all other participants must comply with the safety rules applicable at the session location.

The photographer is not responsible for items left unattended or for their loss, damage or theft unless caused by the photographer’s actions.

Parents and legal guardians are responsible for supervising children during the session.

The person responsible for an animal is liable for its behaviour and for any damage it causes.

The client is responsible for damage caused by the client or by any people, children or animals under their supervision in the studio, rented venue or any other session location.

The photographer is not responsible for limitations in the results caused by circumstances beyond her control, including late arrival, the behaviour or well-being of participants, restrictions at the location or failure to follow the advice provided before the session.

 

19. ADDITIONAL SERVICES

Prints, albums, photo books, boxes, USB drives and other photographic products may be ordered separately.

Additional products will be priced according to the current price list or a personalised quotation.

Production times for printed products depend on the type of order and the external laboratory’s production schedule.

Printed colours may differ slightly from those displayed on a screen because of device settings and printing technology.

Projects for agencies, magazines, brands, companies and corporate clients, as well as professional styling, complex productions, special sets and props, are quoted individually.
